Nebraska Voters to Decide Online Sports Betting as Prediction Markets Expand

Nebraska voters will decide in November whether to allow online sports wagering, potentially creating a regulated sportsbook market alongside prediction platforms such as Kalshi and Polymarket that are already offering sports-related contracts in the state.

Nebraska’s Secretary of State certified two citizen-led measures for the Nov. 3 general election, setting the stage for a statewide vote on the future of online sports betting.

One proposal would amend the state constitution to permit online wagering, while a separate statutory initiative would establish the licensing, taxation and regulatory framework for the industry.

The campaign behind the measures says online betting could generate additional tax revenue while directing a substantial portion of those funds toward property-tax relief.

Two Measures Will Go Before Nebraska Voters

The two proposals were submitted by Tax Relief Nebraska, which collected more than 201,000 signatures for the constitutional amendment and approximately 146,000 for the regulatory initiative.

Both measures cleared the required signature thresholds and were certified for the November ballot.

Because the proposals are separate, voters could potentially approve one while rejecting the other. That creates an unusual scenario in which Nebraska could endorse online sports wagering without simultaneously approving the proposed regulatory framework, or approve the framework without authorizing the underlying activity.

If approved, the measures would establish a legal framework for online sportsbooks and limit operators to two platforms per licensee at any given time.

They would also require wagering servers to be physically located in Nebraska, while the Nebraska Racing and Gaming Commission would be responsible for developing detailed regulations.

Sportsbook Giants Are Funding the Campaign

The campaign has attracted significant financial backing from major U.S. sportsbook operators.

Campaign filings show that FanDuel and DraftKings each contributed roughly $3.5 million toward efforts to place online sports betting before voters.

WarHorse, an in-state casino operator supporting the initiative, has also reportedly entered agreements with FanDuel, DraftKings and MGM to operate online betting platforms if the proposed framework is approved.

That means the companies backing the campaign already have commercial plans for the Nebraska market should voters give online wagering the green light.

Prediction Markets Already Offer Sports Contracts

The ballot measures arrive as Nebraska residents already have access to another form of event-based financial product.

Platforms such as Kalshi and Polymarket offer contracts tied to sports and other events. Their business models differ from conventional sportsbooks, with the platforms operating through prediction-market structures rather than traditional state-licensed sports betting.

Because these markets operate under a different regulatory framework, they have become an increasingly important part of the debate surrounding the boundary between sports wagering and federally regulated prediction markets.

Nebraska has not been among the states that have taken legal action or issued cease-and-desist orders against the two platforms.

As a result, prediction-market products are available to Nebraska users while voters are still deciding whether conventional online sportsbooks should receive authorization.

That creates a potential competitive overlap: a newly regulated sportsbook industry could enter a market where prediction platforms already have customers and established liquidity.

Property Tax Relief Is a Major Selling Point

Supporters are emphasizing the potential fiscal benefits of legalization.

The proposed legislation would direct 70% of online gambling tax revenue toward property-tax credits, mirroring the share of casino gaming taxes currently allocated to property-tax relief.

A campaign-commissioned analysis estimated that online sports wagering could generate slightly less than $87 million over five years.

Supporters point to Nebraska’s existing casino industry as evidence that gambling-related taxes can provide meaningful revenue for taxpayers. State figures show that the state’s five casinos generated more than $52 million in gaming taxes during 2025, with approximately $36.6 million directed toward property-tax credits.

Opponents, however, have questioned whether projected online betting revenue justifies expanding gambling access.

Petition-Fraud Investigation Adds Another Layer

The ballot campaign has also unfolded alongside an investigation into alleged petition irregularities.

County election officials referred suspected petition fraud to law enforcement, prompting the Lancaster County Sheriff’s Office to broaden its investigation to all four statewide citizen initiatives appearing on the 2026 ballot.

Authorities have said thousands of signatures across the various campaigns were being reviewed.

The investigation does not mean the online sports-betting measures themselves are invalid. Suspect signatures are removed during the verification process, and the certified totals already reflect the signatures that election officials determined were valid.

Supporters of the sports-betting measures have said their campaign used a separate petition firm and that signatures were reviewed during the collection process.

Nebraska Could Face a Changing Regulatory Landscape

If voters approve the proposals, Nebraska would join a growing number of states attempting to establish rules for online sports betting while federal prediction markets continue expanding.

Other states are taking different approaches to the overlap.

Some jurisdictions are considering taxes on prediction-market activity, while others are exploring restrictions that could prevent traditional sportsbooks from participating as market makers on prediction platforms.

Another approach is to regulate sports-event contracts directly through existing gambling frameworks.

The divergence reflects a larger unresolved question in the U.S. market: where should regulators draw the line between sports betting and financial contracts based on sports outcomes?

November Vote Could Shape the Market

The Nebraska measures now move from the signature-qualification stage to the political campaign ahead of the November election.

The Secretary of State’s office is expected to finalize the statewide ballot by Sept. 11, with public hearings scheduled across Nebraska’s three congressional districts.

If voters approve online wagering, regulators would then have to establish licensing requirements, technical standards, taxation rules and compliance procedures before the market could launch.

For Nebraska, the vote is therefore about more than simply adding sportsbooks. It could determine how a state-regulated betting industry competes and interacts with a rapidly expanding prediction-market sector that is already operating under a separate federal framework.

The outcome could provide another important test of how U.S. states respond as traditional sports betting and blockchain-based prediction markets increasingly compete for the same users.
