Internet Freedom Foundation Calls India’s BitChat GitHub Takedown Order “Unconstitutional”

India’s Internet Freedom Foundation (IFF) has criticized a government directive seeking the removal of repositories associated with BitChat from GitHub, arguing that the order exceeds the government’s legal authority and could have serious implications for free expression, open-source development and access to decentralized communication technologies.

The controversy centers on BitChat, a decentralized messaging application associated with Jack Dorsey that allows users to communicate without relying on conventional internet infrastructure or centralized servers.

Indian authorities reportedly directed GitHub to disable access to three BitChat-related repositories, citing concerns that the technology could be used to circumvent internet shutdowns, avoid lawful surveillance and potentially facilitate illegal activities.

IFF, however, argues that restricting access to publicly available software code based primarily on how the technology could potentially be used raises significant constitutional and legal questions.

IFF Challenges the Legal Basis of the Takedown Order

A central part of IFF’s criticism concerns the legal mechanism reportedly used by the government to issue the removal notice.

According to the digital rights organization, authorities relied on Section 79(3)(b) of India’s Information Technology Act rather than using the country’s established legal framework for formally blocking online content.

IFF argues that this distinction is important.

Formal blocking procedures generally contain specific procedural requirements and safeguards intended to regulate when and how the government can restrict access to online information.

By relying instead on an intermediary-liability provision, IFF claims the government may have attempted to achieve the practical effect of blocking online material without following the full process normally associated with such restrictions.

The organization has called for the notice to be withdrawn and has also urged authorities to disclose takedown orders issued under the provision, arguing that greater transparency is necessary when government requests affect access to online information and software.

Government Raises Concerns Over Surveillance and Internet Shutdowns

The government’s concerns appear to focus primarily on BitChat’s decentralized architecture.

Unlike conventional messaging platforms, which generally depend on internet connections, cloud infrastructure and centralized servers, BitChat is designed to allow nearby devices to exchange encrypted messages using Bluetooth-based networking.

That architecture could allow communication to continue even when conventional internet connectivity is unavailable or deliberately restricted.

Authorities reportedly raised concerns that such technology could enable users to bypass internet shutdowns, make lawful surveillance more difficult and potentially provide communication channels that could be exploited for unlawful activities.

These concerns highlight a growing challenge for governments as decentralized communication technologies become increasingly sophisticated.

Traditional internet controls generally operate through centralized infrastructure, including internet service providers, websites, servers and online platforms.

Decentralized peer-to-peer technologies can reduce dependence on those centralized points of control.

IFF Says No Specific Illegal Content Was Identified

IFF has challenged the government’s reasoning on another important point: the reported takedown notice did not identify specific unlawful content contained within the targeted software repositories.

Instead, according to the organization, the concerns were largely connected to what the technology itself enables.

That distinction could have broader implications for open-source software.

A software repository typically contains source code, technical documentation and development resources. The code itself may have many legitimate applications even if the resulting technology could also potentially be misused.

IFF’s position raises a fundamental question: Should software code be restricted because of illegal content it contains, or because authorities believe the technology could potentially be used for illegal purposes?

The answer could establish an important precedent for privacy tools, encryption software and decentralized applications.

What Is BitChat?

BitChat is a decentralized messaging application designed to enable communication between nearby devices without depending on traditional internet connectivity or centralized messaging infrastructure.

The application uses Bluetooth-based networking to transmit encrypted messages between devices.

This architecture can be particularly useful in situations where internet infrastructure is unavailable, unreliable or intentionally restricted.

For example, decentralized communication tools can potentially provide connectivity during natural disasters when telecommunications infrastructure is damaged.

They can also function during major network outages or in remote areas with limited internet access.

The same characteristics, however, can make decentralized messaging difficult for authorities to monitor or restrict.

That tension between communication resilience and government oversight sits at the center of the BitChat controversy.

BitChat Has Gained Attention During Internet Disruptions

Since its release in July 2025, BitChat has reportedly attracted growing interest during periods of political unrest, natural disasters and internet disruptions.

Adoption has reportedly increased during periods of instability or connectivity restrictions in countries including Madagascar, Nepal, Uganda, Jamaica and Iran.

This reflects a broader trend in digital communications.

When conventional internet infrastructure becomes unavailable, users increasingly turn toward technologies capable of operating independently of centralized networks.

Mesh networks, Bluetooth messaging, satellite connectivity and peer-to-peer communication protocols are all emerging as potential alternatives.

For governments, these technologies create difficult policy questions.

They can provide critical communications infrastructure during emergencies while simultaneously reducing the effectiveness of traditional internet restrictions and surveillance mechanisms.

GitHub Takedown Raises Broader Open-Source Questions

The controversy also extends beyond BitChat itself because the targeted material reportedly involves software repositories hosted on GitHub.

Open-source repositories are fundamental infrastructure for modern software development.

Developers use them to publish code, collaborate on projects, identify security vulnerabilities and build new applications.

Restricting access to repositories therefore differs from simply blocking access to an online service.

Even if access to a functioning application is restricted, publicly available source code can allow developers to study, modify or independently reproduce the underlying technology.

This creates a particularly difficult enforcement problem for decentralized software.

Once open-source code has been publicly distributed, copies can be replicated across different repositories, platforms and jurisdictions.

Removing one repository does not necessarily eliminate the software.

Instead, government restrictions may encourage developers and users to mirror the code elsewhere.

The Case Highlights the Growing Conflict Between Decentralization and Government Control

The BitChat dispute reflects a much larger technological shift.

Governments historically exercised significant control over digital communications because most internet services relied on centralized infrastructure.

Websites had identifiable hosting providers.

Messaging platforms operated centralized servers.

Internet service providers controlled network access.

That architecture created clear points where authorities could impose restrictions.

Decentralized technologies fundamentally change that model.

When communication happens directly between devices, governments may have fewer centralized intermediaries through which restrictions can be enforced.

The same challenge is already visible across encrypted messaging, blockchain networks, decentralized finance and peer-to-peer file sharing.

BitChat brings that debate into offline-capable messaging.

A Potential Test Case for Digital Rights in India

The dispute could become an important test of how India regulates decentralized and open-source technologies.

At its core, the controversy involves several competing priorities: national security, law enforcement, freedom of expression, privacy, software development and access to communications.

Governments have legitimate concerns about technologies being exploited for criminal purposes.

At the same time, digital rights advocates argue that restricting general-purpose technologies solely because they can potentially be misused risks creating overly broad censorship powers.

The central question may ultimately extend far beyond one messaging application.

As decentralized technologies become capable of operating without centralized servers, internet providers or even continuous internet connectivity, governments worldwide will need to determine how existing laws apply to systems that were specifically designed to eliminate traditional points of control.

The BitChat controversy illustrates how that conflict is beginning to move from theoretical debates into real-world regulation.

For developers and digital rights advocates, the outcome could help determine whether governments can restrict access to open-source code based primarily on a technology’s capabilities rather than specific unlawful content.

And for governments, it highlights an increasingly difficult reality: in a world of decentralized and offline-capable communication, shutting down the internet may no longer mean shutting down communication.
