US Senate Sets September Vote to Advance CLARITY Act as Thune Files Cloture

The U.S. Senate is preparing to vote in September on whether to advance the Digital Asset Market Clarity Act, widely known as the CLARITY Act, after Senate Majority Leader John Thune filed a cloture motion to bring the legislation forward.

The procedural move puts the long-delayed crypto market structure bill back on the Senate’s agenda, although lawmakers still have several weeks to resolve major disagreements before the vote.

The Senate is expected to reconvene on September 15, with the procedural vote likely to follow. The additional negotiating window could prove critical as lawmakers continue discussions over ethics provisions, stablecoin rewards and other elements of the legislation.

Thune Files Cloture to Move CLARITY Act Forward

Thune’s filing of cloture represents an important procedural step toward bringing the CLARITY Act to the Senate floor.

However, the move should not be confused with a vote to pass the legislation.

A cloture vote determines whether the Senate can proceed with consideration of the bill and requires 60 votes. That means Senate Republicans will likely need support from Democrats to clear the procedural hurdle.

If the motion succeeds, lawmakers can formally begin debating and considering amendments to the legislation.

The development therefore represents progress, but it does not guarantee that the CLARITY Act will ultimately pass the Senate.


Why the September Vote Matters

The CLARITY Act had been expected to move forward before the Senate’s August recess, but negotiations failed to produce a final agreement.

Several unresolved issues have complicated the process, including proposed ethics restrictions and disagreements surrounding stablecoin incentives and rewards.

The delay has pushed the legislative timeline into September, giving lawmakers additional time to negotiate a compromise.

For the crypto industry, the timing is significant because the CLARITY Act is viewed as one of the most important attempts by Congress to establish a comprehensive federal framework for digital assets.


What the CLARITY Act Would Change

If enacted, the legislation would establish clearer rules governing the U.S. digital asset market.

Among its most important objectives are determining when digital assets should fall under securities or commodities regulations and establishing clearer responsibilities between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC).

The legislation could therefore provide greater clarity for crypto companies, exchanges, investors and financial institutions that have operated for years under overlapping or uncertain regulatory frameworks.

For the industry, the distinction between securities and commodities is particularly important because it determines which regulator has primary oversight and what compliance obligations businesses must follow.


Ethics Provisions Remain a Major Roadblock

One of the most politically sensitive issues surrounding the legislation involves proposed ethics provisions.

Democrats have pushed for restrictions that would prevent government officials and their immediate families from issuing, promoting or financially benefiting from certain digital assets while holding public office.

The issue has attracted additional attention because of President Donald Trump’s involvement in the cryptocurrency industry and his family’s broader digital asset interests.

Lawmakers have reportedly been working on a bipartisan ethics addendum designed to address those concerns and potentially clear the way for the broader market structure legislation.

One proposal reported by Bloomberg would require the president to divest from certain crypto-related businesses.


Stablecoin Rules Add Another Layer of Complexity

Ethics are not the only issue delaying the legislation.

Lawmakers are also negotiating provisions affecting stablecoins, including rules around rewards and incentives.

Stablecoins have become one of the most important areas of the U.S. digital asset market, particularly as policymakers consider how dollar-backed tokens should interact with traditional financial institutions and payment systems.

The final language could therefore have significant consequences for stablecoin issuers, exchanges, banks and other companies building infrastructure around digital dollars.


A Procedural Win, Not Yet a Legislative Victory

Thune’s cloture filing gives the CLARITY Act a clearer path toward Senate consideration after months of uncertainty.

But several hurdles remain.

First, the Senate must approve the procedural motion with the required 60 votes.

Then lawmakers must work through debate and potential amendments.

The legislation would ultimately need to pass the Senate before differences between the Senate and House versions could be resolved and the bill could move toward the president’s desk.

In other words, September could mark the beginning of the next phase of the CLARITY Act rather than the end of the legislative process.


What Crypto Markets Will Be Watching

The September vote could become an important catalyst for the U.S. crypto market.

A successful procedural vote would signal that lawmakers have made meaningful progress toward a bipartisan compromise and could increase expectations that comprehensive market structure legislation will eventually become law.

A failure to secure the necessary votes, meanwhile, could revive concerns that political disagreements will continue delaying regulatory clarity.

For crypto businesses, the stakes extend beyond the legislation itself.

A clearer division between the SEC and CFTC could influence how tokens are launched, traded and regulated in the United States, while clearer market rules could make it easier for traditional financial institutions to participate in digital assets.

The Bigger Picture

The filing of cloture marks a meaningful step forward for the CLARITY Act, but the legislation still faces substantial political and procedural hurdles.

The weeks before the Senate returns on September 15 will likely be critical as lawmakers attempt to resolve the remaining disputes.

For the crypto industry, the key question is no longer simply whether Congress will debate market structure legislation.

It is whether lawmakers can finally reach enough bipartisan agreement to turn regulatory clarity from a political objective into federal law.
